Official Rules and Exclusion for the 2007
Home for a Hero - Freedom Home Giveaway
The following promotion is intended for viewing in the United States only (including its territories, possessions, and commonwealths, except Puerto Rico ) and will be construed and evaluated according to United States laws. Do not proceed in this site if you are not a legal U.S. resident, 18 years or older, and accessing this site in the United States , its territories, possessions, or commonwealths (except Puerto Rico ).
How to Vote: Beginning at 10:30 pm Mountain Standard Time ("MST") on August 5th, 2007 until 10p.m. MST on August 17 th , 2007 , you may vote for the any of the three nominated soldiers in the following ways: online by visiting the Alta Vista Home website (www.altavistahomes.com), or (ii) Email you vote to laura@altavistahomes.net . Please limit your comments to only include the name of solider you are voting for and the house you have selected for them. E-mail's including derogatory or negative comment concerning this year's selectees will not count. There are no exceptions.
How the nominated soldiers were chosen . The soldiers chosen for this year's home giveaway were nominated by the Military.
The following list is the criteria the Selectees for the “Home for the Hero” had to meet to become a selectee in this years giveaway.
• Must have been on active duty within the last 3 years
• Must have sustained a life changing injury while on duty
• Must have been injured in combat or other military related service
Criteria for injuries must include:
• Injuries that prohibit you from earning a living that will sustain your family. Injuries that limit: mobility, speech, sight, hearing, cognitive thought, and memory.
• Must be a resident of Utah and must be 18 years or older to be nominated.
• Must be primary provider for your home
• Must be able to verify income and disability due to injury
• Must be willing to tell their story publicly
• Nominee must be willing to move to Eagle Mountain in Utah County .
• Nominee must be willing to sign a contract for the following: (a) a release of information for your story to be told, (b) An agreement to reside in the home for a minimum of 3 years and may not sell the home until that time, (c) If you are a home owner and must sell your home current home, the proceeds from the sell of that home will be given to Mike's Guardian's Eagle Foundation, (please keep in mind that the home received is free and clear from a mortgage payments and liens. Prize cannot be transferred to any other persons
How the winner will be determined? There are two ways the winner will be determined.
• The public vote . The public may place their vote for a two week period beginning at 10:30 pm on August 5 th , 2007 . This vote will count for 25 percent of the total points.
• A committee of local business leaders and the board of directors of Mikes Guardian Eagle Foundation will make up the final 75 percent of the vote.
Voting will be closed at 10:00 pm on August 17 th. Any emails received after the 17 th of August will not be included in the vote.
Who will receive the Freedom Home Giveaway: (1) One family will be chosen by the public to receive a custom made home.
All fees, costs and expenses associated with the building of the Freedom Home will be paid by Alta Vista Homes LLC. All property taxes, HOA Fees, etc. after the home is received are the responsibility of the winner of the home.
The Grand Prize will be awarded: By Mikes Guardian Eagle Foundation, Alta Vista Homes LLC, DAI Land Development, KUTV Channel 2 and their sponsors of this years Home for a hero on August 20th. This date is subject to change based on availability of the soldier, their families and the Home for the Hero partners and sponsors. Schedule changes will be announced in advance. After the winner has been announced the construction of the home will begin.
Exclusions: The following persons are not eligible to participate as nominees for the Freedom Home Giveaway.
• All employees, owners, directors, agents, as well as their immediate family (spouse, parents, siblings and children) and household members.
• All suppliers, distributors, subcontractors, laborers as well as their immediate family (spouse, parents, siblings and children) and household members.
• Any and all sponsors connected in any way to the building of this home their immediate family (spouse, parents, siblings and children) and household members.
• All board members and directors of Mike's Guardian Eagle Foundation their immediate family (spouse, parents, siblings and children) and household members.
Declaimer of Liability includes but is not limited to the following:
• Becoming a soldier selected to participate in the Home for a Hero giveaway does not guarantee that you will receive a home.
• If you are a soldier that is chosen to participate you will sign an agreement to release your story to the public.
• Alta Vista Homes, Mike's Guardian Eagle Foundation, DAI Land Development, KUTV Channel 2 nor any of its agents, consultants or employees shall be held liable for any improper or incorrect use of the information described and/or contained herein and assumes no responsibility for anyone's use of the information.
• In no event shall Alta Vista Homes, Mike's Guardian Eagle Foundation, DAI Land Development, KUTV Channel 2 or its agents or consultants or employees be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement or substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this web site, even if advised of the possibility of such damage.
• This disclaimer of liability applies to any damages or injury, including but not limited to those caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence or under any other cause of action
Use of Information by Alta Vista Homes LLC
We use the information we gather on the Alta Vista Web site, whether personal, demographic, collective or technical, for the purpose of determining a public vote.
We will use the information we gather to provide the selection committee with an overview of public opinion. The number of votes for each selectee will be tallied and a report will be provided to the selection committee. No personal comments weather positive or negative will have any bearing on the selection process. The vote from the Public will count as 25% of the total points earned. Neither Alta Vista Homes LLC. nor its affiliated partners or sponsors will contact you about your opinion.
Changes to Statement
We reserve the right to change this Statement and apply such changes retroactively to Information we provide. If we decide to change this Statement, we will post those changes here.
